By browsing the Site, submitting an inquiry, or otherwise interacting with our team, you agree to these Terms. If you don’t agree, please don’t use the Site.
The Site is intended for individuals who are at least 18 years old and legally able to enter into a residential lease or purchase, commercial lease, or retail lease agreement. By using the Site, you represent that you meet this requirement.
Everything on this Site, including floor plans, square footage, pricing indications, renderings, photography, unit counts, delivery timelines, and descriptions of amenities, retail tenants, or office space, is provided for general informational and marketing purposes only. Nothing on the Site constitutes:
One Phoenix is committed to compliance with the federal Fair Housing Act and Arizona fair housing law. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, or disability in the marketing, leasing, or sale of any residence. Commercial office and retail leasing is likewise conducted without unlawful discrimination under applicable federal, state, and local law. If you believe you have experienced discrimination, you may contact the U.S. Department of Housing and Urban Development or the Arizona Attorney General’s Office, in addition to reaching out to us directly.
We work to keep information on the Site current, but a project of this scale spanning residential, office, and retail leasing across multiple construction phases means details can change without notice. Availability, pricing, and delivery dates in particular are subject to change based on construction progress, market conditions, and leasing activity. Always confirm current details directly with our leasing office before making decisions based on Site content.
The Site and its content, including the One Phoenix name and logo, building renderings, photography, floor plan graphics, written descriptions, and the layout and design of the Site itself, are owned by or licensed to One Phoenix and are protected by copyright, trademark, and other intellectual property laws. You may view and share pages of the Site for personal, non-commercial reference (for example, sending a floor plan link to a family member), but you may not reproduce, distribute, modify, or create derivative works from Site content for commercial purposes including use by competing developments, brokerages, or marketing agencies without our prior written consent.
When you submit an inquiry form indicating interest in residences, office suites, retail space, or general information, you’re authorizing our leasing team (and marketing partners acting on our behalf) to contact you about One Phoenix by phone, email, or text, consistent with our Privacy Policy. Please don’t submit personal information belonging to someone else without their permission.
The Site may link to third-party sites, social media, mapping tools, brokerage platforms, or nearby district partners such as those referenced in our Locations page. We don’t control and aren’t responsible for the content, accuracy, or practices of those third-party sites.
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that renderings, floor plans, or availability information will remain accurate as the project progresses.
To the fullest extent permitted by Arizona law, One Phoenix and its owners, developers, affiliates, employees, and agents won’t be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site including damages relating to reliance on floor plans, pricing, availability, or delivery timelines shown on the Site even if we’ve been advised of the possibility of such damages. Nothing in these Terms limits liability that can’t be limited under applicable law.
You agree to indemnify and hold harmless One Phoenix and its owners, developers, affiliates, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
We may revise these Terms as the project moves through pre-leasing, construction, and occupancy phases. We’ll update the “last updated” date above when we do. Continuing to use the Site after changes take effect means you accept the revised Terms.
